How does a bail bond work?

Booking Process 

When one has been accused of a crime, they are usually brought to the police station to be booked.  The booking process typically lasts 4-8 hours. During which time the police will conduct criminal background checks, warrant checks, mug shots, fingerprinting and the removal of most personal effects (such a wallets, watches etc.).  For misdemeanors (less serious crimes), the defendant may be "cited-out" with no need for bail.  For more serious crimes, the defendant will be placed into a jail cell and bail will likely be set. 

Bail is set by Jailor or Judge

The amount of bail depends on the serious nature of the crime.  For example, a charge like murder might have a bail of $1,000,000.  Crimes like drug possession, domestic violence or driving under the influence may have a bail of $10,000 - $50,000.  Bail is set by the jail staff who utilize a San Francisco Bail Schedule to determine the proper bail.

Calling a Bail Bond Agency

If a defendant chooses to bail out with a bail bondsman, often a friend and/or a family member will contact the bail bond agent by phone.  The agent will gather basic information about the situation (such as the defendant's name, date of birth and jail location).  The cost of a bail bond is generally 10% (rates are set by California law by the California Department of Insurance).  As a simple example, let's say the bail is set at $50,000.  In this case, the premium that one would pay to a bail bond company would be $5,000.
